Risk, responsibility and liability in multifunctional agriculture
Multifunctional agriculture (MFL) companies receive many visitors to their farms. That gives questions about risks, responsibility and liability for you as farmer. You have a nice diversified farm with, in addition to agriculture, also activities in recreation, farm sales, education, care, childcare or nature management. Therefore you receive visitors to the farm, you take care of your clients, you take care of children or you organize outdoor sport events. In the unlikely event that something goes wrong, this can pose a risk and even damage to visitors. Also, a forgotten tool or dirt on your premises can be the reason of accident and damage of visitors. Are you liable?
You are always responsible for your visitors, guests, clients, employees and volunteers, but you are not always liable. Your duty is to be responsibility to all visitors to your farm. Liability concerns the prosecution for damage to a third party, caused within your responsibility. Realize that these words (responsibility and liability) are two concepts: you have to take responsibility yourself and you can insure liability.
